1. Introduction

Choice2mobile Technology Limited, trading as Wifiber, is a telecommunications infrastructure provider in Nigeria regulated by the Nigerian Communications Commission (NCC). These Terms of Service ("Terms") constitute a legally binding agreement between you and Wifiber governing your access to and use of our internet services, subscriber portal, and mobile application (collectively, the "Services").

This Code of Practice is issued under the Consumer Code of Practice Regulations 2007 and applies to all service and product offerings including software, websites, social networks, app stores, and updates. By accessing the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

2. Effective Date

These Terms were first effective 13 December 2023 and were last updated 1 August 2025. All subscribers — existing and new — who use the Services after this date are bound by the current version. We will notify you of material changes as described in Section 17.

3. Account Access & Credentials

Admin-created accounts. Wifiber does not offer public self-registration. Subscriber accounts are created exclusively by authorised Wifiber administrators. Your login credentials (username and temporary password) are communicated to you directly through our approved channels after your service contract is established.

Wifiber cannot be held responsible for any loss arising from your failure to protect your login credentials.

4. Acceptable Use & Prohibited Conduct

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

Wifiber reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision.

5. Provision of Information to Consumers

5.1. Wifiber shall, upon request, provide a copy of the contract or agreement for the provision of services. Such contracts shall be written in clear, plain language.

5.2. Copies of duly approved Individual Codes of Practice shall be made available to consumers on request.

6. Consumer Education

Wifiber proactively educates consumers through its website, mobile application, social media platforms, and customer service channels on consumer rights, available services, pricing structures, and how to lodge complaints.

7. Pricing and Billing

All charges for services shall be clearly communicated to consumers before subscription. Billing shall be conducted in accordance with agreed terms.

Refund Policy: Payments for internet subscription plans are generally non-refundable once service has been activated, except where required by applicable law or where Wifiber is unable to deliver the contracted service. Refund requests must be submitted within 7 days of the billing date and will be evaluated on a case-by-case basis. Contact support@wifiber.ng to initiate a refund request.

8. Payment Processing & Third-Party Gateways

Wifiber uses third-party payment processors to handle subscription payments made through the application. These processors may include, but are not limited to, Paystack and Flutterwave (or other NCC-approved gateways). By making a payment through the application, you also agree to the terms and privacy policies of the relevant payment processor.

9. Subscription Pause & Plan Changes

Eligible subscribers may temporarily pause their active subscription through the application, subject to the following conditions:

10. Consumer Complaints

Wifiber maintains effective, transparent, and easily accessible mechanisms for receiving and resolving consumer complaints.

11. Account Suspension & Termination

By Wifiber: We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, if:

By You: You may request termination of your account by contacting our support team. Account termination does not automatically entitle you to a refund for any unused subscription period. We will process account closure and data deletion in accordance with our Privacy Policy and applicable law.

Effect of Termination: Upon termination, your right to access the Services ceases immediately. Data retention after termination is governed by our Privacy Policy (Section 5).

12. Intellectual Property

All content, features, and functionality within the Wifiber application — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are the exclusive property of Choice2mobile Technology Limited or its licensors and are protected by Nigerian and international intellectual property laws.

13. Mobile Application & Software Updates

The Wifiber mobile application is available on iOS and Android platforms. By downloading and using the application, you agree to these Terms in addition to the terms of the Apple App Store or Google Play Store through which you obtained it.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Wifiber shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation, loss of profits, data, use, goodwill, or other intangible losses — resulting from:

Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you for the Services in the three (3) months preceding the claim.

15. Children's Use

The Wifiber subscriber application is intended for use by adults aged 18 years and above. Our Services are not directed to children under the age of 13, and we do not knowingly create accounts for or collect personal information from children under 13.

Since accounts are created exclusively by administrators for verified subscribers — who must be adults under their service contract — no minor can self-register for an account. If we become aware that a person under 13 is accessing the Services, we will take appropriate steps to restrict that access.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

17. Changes to These Terms

Wifiber reserves the right to update or modify these Terms at any time. Material changes will be notified to subscribers at least 14 days in advance via in-app notification, email, or SMS. Continued use of the Services after the effective date of changes constitutes your acceptance of the revised Terms.

The current version of these Terms is always accessible at https://app.wifiber.ng/terms.html and within the application under Settings > Terms of Service.
